Who is responsible for your information

HJK Consulting is the trading name of Jaco Klynsmith, an independent integrated marketing communications consultant based in Windhoek, Namibia. The data controller for the information described in this policy is Jaco Klynsmith, which means I decide what is collected and why.

What this site collects

There are three ways this website collects information about you.

Enquiries you send me. The contact form asks for your name, your email address, your company name and your message. Company name is optional. Everything you type into that form comes to me, and nothing else is added to it.

Analytics, if you allow it. If you accept cookies, Google Analytics records how the site is used. That covers pages viewed, roughly how long you stayed, the country or city your connection resolves to, the type of device and browser you used and the site or search that sent you here. It does not tell me your name and I do not use it to identify individuals. If you decline, or if you never answer the banner, Google Analytics does not run and no analytics cookies are set.

Server logs. The hosting provider records standard access logs, including IP addresses and requested pages. These exist to keep the site running and secure. I do not use them for marketing.

Cookies and similar technologies

Cookies are small files a site stores in your browser. This site sets no cookies at all until you press Accept on the consent banner. The only thing stored before that point is your answer to the banner itself, which is kept in your browser's local storage so you are not asked on every page.

You can change your mind at any time using the Cookie Settings link in the footer of every page. Declining will also clear analytics cookies already stored. You can additionally block or delete cookies through your browser settings, though some sites will behave oddly if you block everything.

Why I process it, and on what legal basis

• To answer your enquiry and discuss possible work. The legal basis is that processing is necessary to take steps at your request before entering a contract, and my legitimate interest in responding to people who contact my business.
• To understand how the site is used and improve it. The legal basis is your consent, given through the cookie banner and withdrawable at any time.
• To keep the site available and secure. The legal basis is my legitimate interest in operating the site safely.
• To meet legal and tax obligations where an enquiry becomes an engagement. The legal basis is compliance with a legal obligation.

I do not sell your information, I do not share it with advertisers and I do not add you to a mailing list because you filled in the contact form.

Who else sees it

A small number of service providers process information on my behalf. Each one is bound to use it only for the service it provides.

• Formspree receives contact form submissions and forwards them to my email. Formspree is based in the United States.
• Google Analytics processes site usage data, but only once you have accepted.
• Google Fonts serves the typefaces this site uses. Loading a font passes your IP address to Google. This happens on page load and is not covered by the consent banner, because the fonts are part of how the page renders.
• Namhost hosts the website and its server logs. Namhost is based in South Africa.

I may also disclose information where the law requires it, or where it is necessary to establish or defend a legal claim.

Information leaving your country

I am based in Namibia, and the providers listed above are based in Namibia, South Africa and the United States. If you are in the European Economic Area or the United Kingdom, this means your information is transferred outside that area. Those transfers rely on the standard contractual clauses published by the European Commission, which the providers concerned incorporate into their terms.

How long it is kept

• Enquiries are kept while we are in conversation and for 24 months after our last contact, so that I have context if you come back. After that they are deleted.
• Client records that arise from an engagement are kept for as long as the law requires for tax and accounting purposes.
• Analytics data is retained by Google for 14 months and then deleted automatically.
• Server logs are held on the standard cycle operated by the host and are overwritten in the normal course.

Your rights

You can ask me to do any of the following, and I will respond within 30 days.

• Tell you what information I hold about you and give you a copy.
• Correct anything that is wrong or incomplete.
• Delete what I hold, where there is no legal reason for me to keep it.
• Restrict or object to how I use it, including any use based on legitimate interest.
• Provide your information in a portable, machine readable format.
• Withdraw your consent to analytics, which you can do yourself through Cookie Settings.

Withdrawing consent does not affect anything processed before you withdrew it. There is no charge for any of this. Write to jaco@hjk.com.na and say what you want done.

If you are not satisfied

Raise it with me first and I will try to resolve it. If you are in the European Economic Area or the United Kingdom and you remain unhappy, you have the right to complain to the data protection supervisory authority in the country where you live or work.

Security

The site is served over HTTPS, enquiries reach me through an encrypted connection and access to my systems is protected by strong authentication. No method of transmission over the internet is completely secure, so I cannot guarantee absolute security, but I take the protection of what you send me seriously.

Children

This site is aimed at businesses and is not intended for children. I do not knowingly collect information from anyone under 16. If you believe a child has sent me information, contact me and I will delete it.

Changes to this policy

If the way this site handles information changes, this page changes with it and the date at the top is updated. Where a change materially affects your rights, the consent banner will reappear so you can make a fresh choice.
